Photography Contract
This Agreement is made effective as of date signed below by client and between client and Tara Michele Photography & Custom Signs, LLC.
1. Scope of Work: Photographer agrees to provide photography services as outlined below:
Type of Session: Listed on Invoice or booking form
Date and Time: Listed on Invoice or booking form
Location: Listed on Invoice or booking form
Duration of Session: Listed on Invoice or booking form
2. Deliverables:
Edited and color-corrected high-resolution digital images.
Print release for all images (option to print through Photographer).
Online viewing/sharing gallery for friends and family.
Images will be delivered within 2 - 10 days of the session date.
3. Payment:
Deposit: 50% of the Total Fee
Balance: Remaining 50% of the Total Fee (due on or before the day of the event/shoot)
4. Retainer and Payment:
A 50% deposit of the Total Fee is required to reserve the session date and time. The deposit is non-refundable, subject to the terms in section 5.
The remaining balance is due on or before the day of the event/shoot.
5. Rescheduling and Cancellation:
If Client needs to reschedule, a minimum of 72 hours' notice is preferred unless due to an emergency. The deposit will be applied to a new date, subject to Photographer's availability.
If the Client cancels the session, 10% of the total fee plus a 4% processing fee is non refundable.
Photographer reserves the right to reschedule due to unforeseen circumstances, including but not limited to illness, emergency, or unsafe weather conditions.
6. Copyright and Reproduction:
Photographer retains the copyright to all images. Client is granted a print release. Client agrees to give photo credit to said Photographer with social shares or professional use.
7. Image Use:
Photographer will only share images in their portfolio or for other uses with the Client's permission.
8. Liability:
Photographer will take all reasonable precautions to ensure the safety and integrity of the images. However, Photographer is not liable for any loss or damage to the images due to circumstances beyond control, including but not limited to equipment malfunction, theft, or natural disasters.
Photographer's liability for any claim, breach, or damages by reason of any act or omission shall be limited to the amount paid by Client under this Agreement.
9. Completion Schedule:
Digital edited images in an online gallery will be available for viewing within 2-10 days after the session.
10. Miscellaneous:
This Agreement constitutes the entire agreement between the parties and supersedes all prior agreements. Any modifications must be in writing and signed by both parties. This Agreement is governed by the laws of the State of Virginia.
